provided will be completely confidential during this process.
This is your Advice Home, anytime you want more information you can

PROMPT So, {your name} how can I help you today?
FACT you have received an explanation about Occupation Orders
EXPLAIN AS
An Occupation order determines who can live in the family home, it can be
used to remove an abuser from the family home and not come within
a certain distance.
An Occupation order can also allow the applicant to return to the family
home - for example, if you have been thrown out of the
family home.
It can also determine who must pay the morgage and bills on
the family home.
**It is important to note that an occupation order does not alter who
legally owns the property.**
PROMPT That is the end of this section, you can find plently more
information on Occupation Orders in the Advice Home.
FACT you are happy for me to determine whether you meet the requirements
EXPLAIN AS
The first step to an Occupation Order is to understand what you
want the order to enforce - such as wanting someone removed from the home.
You can only apply for an occupation order if you are a victim of domestic
abuse and meet the requirements. The courts will then decide who can live
in the family home and enter the surrounding area.
EXPLAIN false AS Hope you figure this out for yourself then. Bye.
EXPLAIN true AS I'll now ask you some questions to determine whether you
are eligible to apply for an Occupation Order. Remember that all of your
answers are confidential.
FACT how to apply
EXPLAIN AS
1. Firstly you need to know whether you are eligible. If you're not sure
you can find more information in the Advice Home.
2. Next, you'll need to download and fill in an FL401 form and make two copies.
You can find this at:
* https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/866783/fl401-eng.pdf
You can find this under 'Application Documents' in the Advice Home.
Continue
3. You will need to write a witness statement telling the court what has
happened and asking for the order.
It is important that at the end of the witness statement you must use the
following sentence: "I believe that the facts stated in this witness statement
are true". You need to then sign and date the statement.
You can find more advice on writing your witness statement in the Advice
Home under 'Additional Documents'.
4. If you wish to keep your address and telephone number private you must
fill in a C8 form.
You can find this at:
* https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/866783/fl401-eng.pdf
You can find whether you are eligible and how to fill out the form under
'Additional Documents'.
5. Once you have done the above, email or send all the documents to a court
that deal with domestic abuse cases.
If you're not sure where yours is follow this link:
* https://courttribunalfinder.service.gov.uk/search/postcode?aol=Domestic%20violence&_ga=2.96362527.2086267247.1590242347-186376924.1584977790
6. Lastly, you must either ask your solicitor or the courts to then serve a
copy of your application and witness statement to the person on the
application.
Please do not serve the papers yourself.
It may seem like a little overwhelming in list form but it is useful to use
it as a checklist as you work your way through the process. Plus I have all
the information you will need to fill out the required forms in the
Advice Home.
