Designs excluded from registration
Under the old Act, certain designs of a primarily literary or artistic character were excluded from registration under the Act's regulations. Regulation 11 excludes designs for 'articles on which there is printing', such as book jackets, calendars, certificates, forms, dressmaking patterns, greeting cards, labels, leaflets, maps, postcards, stamps etc. These regulations were discussed in
Re Australian Postal Corporation [1992] AIPC 90-857.
Under the
DA, these regulations are no longer necessary, since provision for exclusion can exist under the
Copyright Act 1968 (Cth) as amended.
